Understanding Your Options

In Ohio, there are two options to consider when ending your marriage. In “dissolution”, you and your spouse are able to end your nuptials on your own terms with minimal involvement from a judge. In order to do this, both parties must sign a separation agreement before anything is filed with the court. A judge will then look at the agreement, and if they think it is fair, they will sign off.

If you and your spouse cannot agree on the terms of your separation, a standard divorce is your other option. This requires a judge to end the marriage based on legal grounds. Our state has two options: “fault” and “no-fault” divorces. “Fault” includes adultery, cruelty or drug abuse. “No-fault” is when you are living separately for an entire year or are incompatible.
